Terms of Service

These terms govern your use of the BenchStream mobile application and the website at bench-stream.com (together, "BenchStream"). BenchStream is operated by Kristian Jones, trading as BenchStream, a sole trader established in England ("we", "us", "our"). App Store download coming soon; iOS billing exists in draft source, not a public release. The planned iOS launch includes Free and paid monthly or annual Pro, matching the Android tier features described below, with no public trial. Apple prices are not yet available. Production configuration and real purchase verification remain release gates. Apple-specific legal coverage remains provisional pending professional review; this page does not claim legal approval or release readiness.

Please read these terms carefully. If you do not agree, please do not use BenchStream.

1. Acceptance

By downloading, installing, or using BenchStream you agree to these terms and to our Privacy Policy. If you are using BenchStream on behalf of an organisation (for example a club or school), you confirm that you have authority to bind that organisation to these terms.

2. What BenchStream is

BenchStream is a mobile streaming client. It captures video and audio from your phone, encodes it on the device, and sends it directly to YouTube Live or to a streaming destination you configure yourself (RTMP, HLS, or SRT where enabled in your app version).

BenchStream does not host, transcode, store, or rebroadcast your video. Streaming reliability depends on factors outside our control, including your network connection, your device hardware, YouTube's services, and any third-party destination you have configured.

What Pro is. Pro unlocks functionality that is already present in the copy of BenchStream installed on your device. Purchasing Pro sets an entitlement which the installed app reads, and the unlocked features then run locally on your device. Pro is not a hosted service, a remote service, or access to anything we operate. On Android we use RevenueCat to verify the entitlement, but RevenueCat is a verification provider rather than a Pro service supplied to you. Nothing in Pro causes your video to pass through infrastructure we run.

3. Eligibility

BenchStream is intended for users aged 18 or over and is not directed at children. By using BenchStream, you confirm that you are at least 18.

4. Sign-in and your YouTube account

BenchStream signs in using Google OAuth. We never see your Google password. You are responsible for keeping your Google account secure, for any activity that takes place on your YouTube channel through BenchStream, and for complying with Google's and YouTube's own terms.

BenchStream uses YouTube API Services. By using BenchStream to stream to YouTube you agree to be bound by the YouTube Terms of Service. Google's handling of the data you share when you sign in is described in the Google Privacy Policy.

You can revoke BenchStream's access to your Google account at any time at myaccount.google.com/permissions or through your Google security settings.

BenchStream creates no BenchStream account. Your Google or YouTube sign-in is used for streaming only. It is not your subscription identity, and neither your Google account, YouTube channel, nor selected Brand Account determines who owns a Pro subscription.

YouTube audience classification. When you create a YouTube broadcast in BenchStream, the app reads the selected channel's YouTube audience setting and combines it with any BenchStream default saved for that channel to preselect either "Made for kids" or "Not made for kids". You can change the selection before creating each broadcast. BenchStream does not change the audience classification of a scheduled broadcast selected from YouTube.

You are responsible for choosing the correct audience classification and complying with YouTube's requirements and applicable child-protection and privacy laws. A sports event is not automatically made for kids merely because children participate, but content directed primarily at children must be marked "Made for kids".

5. Acceptable use

You agree not to use BenchStream to stream, transmit, or facilitate any content that:

• Violates the YouTube Community Guidelines, the YouTube Terms of Service, or the terms of any other destination you configure.
• Infringes anyone else's intellectual property, privacy, data-protection, image, or publicity rights.
• Films or broadcasts people, venues, leagues, schools, clubs, music, or events unless you have the permissions, notices, licences, and consents required for your situation, including parental or school permissions where children may be involved.
• Is unlawful, harassing, defamatory, fraudulent, hateful, or designed to harm or exploit minors.
• Attempts to interfere with, reverse-engineer, or circumvent the security of BenchStream, the YouTube API, or any third-party destination.

BenchStream is an encoder, not a content host: we do not see your streams and have no ability to moderate them. Content moderation for material sent to YouTube is governed by YouTube's Community Guidelines and reporting flow. To report a concern about BenchStream itself, email support@bench-stream.com.

A serious breach of this section may terminate the licence granted in section 7.

6. Your content

You retain all rights in the video, audio, scoreboard configurations, team logos, thumbnails, and broadcast metadata you create or configure through BenchStream ("Your Content"). We use it only as needed for the app to process, encode, overlay, and transmit it at your direction. BenchStream does not pass this content through our servers or keep a server copy.

You are responsible for this content and for securing the rights needed to stream it.

7. Our intellectual property

The BenchStream app, website, name, logo, and the bundled scoreboard presets and sport thumbnails are owned by us or our licensors and are protected by copyright and trademark laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the BenchStream app on devices you own or control, for personal or internal organisational use, in accordance with these terms.

You may not copy, modify, distribute, sell, rent, sublicense, or create derivative works based on BenchStream, except as permitted by law (for example, statutory rights that cannot be excluded).

8. Third-party services

BenchStream uses Google and YouTube for sign-in and streaming, and Google Play Billing for Android store transactions. The iOS draft source integrates StoreKit 2 and RevenueCat, but App Store purchases are not publicly available or verified with real purchases yet. The Android app uses RevenueCat for subscription offers, entitlement checks and purchase verification. RevenueCat does not receive your video, audio, or Google/YouTube identity. Our Privacy Policy distinguishes the iOS draft data inventory from the Android contact triggers in section 7.

Your use of Google, YouTube, Apple, Google Play, and any streaming destination is subject to their applicable terms. We are not responsible for their operation, availability, or content, but this does not limit our responsibilities for BenchStream.

If you configure a manual streaming destination (a third-party RTMP, HLS, or SRT server available in your app version), you accept that destination's terms with its operator. Your video, audio, stream keys, credentials, and metadata may be sent to that destination, and its operator is responsible for how it handles them.

9. App store terms

If you obtained BenchStream from Apple's App Store or Google Play, the store's own terms also apply to your download and installation of the app. Where those terms conflict with these terms in relation to the download itself, the store's terms take precedence.

For Apple App Store downloads, Apple is not responsible for BenchStream or for providing support for it. Apple and its subsidiaries are third-party beneficiaries of these terms for App Store downloads and may enforce them against you.

Google Play Pro and App Store Pro are separate products. Google Play Pro unlocks Pro only in the Android app. Planned App Store Pro will unlock Pro only in the iOS app. A subscription does not transfer between stores. If you want Pro on both Android and iOS, you must purchase and maintain one subscription in each store.

The subscription belongs to the app-store account and platform used to buy it. It is not tied to the Google/YouTube account, YouTube channel, or Brand Account selected for streaming. Purchase and restore actions must use the same store and store account. Family access applies only if the store confirms that the subscription supports it.

10. Price, billing and refunds

Free and Pro. BenchStream offers Free and Pro tiers. Free includes unlimited 480p/30fps streaming, YouTube scheduling, manual RTMP destinations, default thumbnails, and sponsor-scene editing. Free has no time limit and requires no payment method. Free streams carry the BenchStream watermark and do not include scoreboards or sponsor scenes on air. Pro, where available on your platform, adds 720p through 4K streaming, the scoreboard overlay, custom thumbnails and club branding, sponsor break scenes on air, and watermark removal. Pro is offered as a monthly or annual recurring subscription. Our pricing page shows indicative regional prices. The price, currency, tax treatment, and billing terms displayed by your app store before purchase are authoritative.

Who takes the payment. Pro is sold through the app store for your current platform. That store collects your payment and holds your payment details, and we never see your card details. On Google Play, Google is the seller on record for purchases made in the United Kingdom and the European Economic Area; for purchases made elsewhere, including the United States, Canada and Australia, Google takes the payment as our agent and we are the seller. Apple seller and trader-duty allocation remains subject to professional legal review by territory before iOS sales; we do not assert a universal Apple seller here. In every case we remain the supplier of the BenchStream service, and the store's transaction terms apply alongside these terms without limiting the statutory rights you have against us as supplier.

No public trial. BenchStream does not currently offer a public trial. Choosing Pro starts the paid monthly or annual subscription shown by the originating store; the store displays the recurring price and renewal terms before you confirm.

Auto-renewal. Pro renews automatically at the end of each monthly or annual billing period until you cancel or change plan. The store charges the payment method it holds for you at the then-current price. If a plan price changes, the store will notify you in advance and confirm whether your agreement is required before the new price applies.

Changing plan. Where the app offers it, you can move between the monthly and annual plans without cancelling. On Google Play the change takes effect immediately in both directions. Moving from monthly to annual charges the full annual price straight away, and the time left on your month is added to the end of your new annual billing period rather than refunded. Moving from annual to monthly charges nothing on the day you switch; monthly billing begins on the date your annual subscription would otherwise have renewed, and you keep the time you have already paid for. iOS plan changes still require real purchase verification; Google Play's settlement rules are not Apple rules. Google Play shows the amount and the date before you confirm, and what the store displays is authoritative.

Restore and manage. On Android, use Restore Purchases in BenchStream on the same platform while the Play Store is signed in to the Google account that made the purchase. Manage Google Play Pro at Google Play subscriptions. iOS purchasing and Restore exist in draft source but still require production configuration and real purchase verification. For future subscriptions billed by Apple, see Apple's subscription settings guidance; this is a store support route, not a publicly available BenchStream iOS management feature. Restoring on one platform cannot restore a purchase from the other store.

How to cancel a renewal. This is the ordinary account action that stops future charges. It is not a refund, and it is not the statutory right to cancel described below. Cancel through the originating store. We cannot cancel a store subscription on your behalf. On Android: Google Play → your profile → Payments and subscriptions → Subscriptions → BenchStream → Cancel subscription. For future Apple-billed purchases: Settings → your name → Subscriptions → the subscription → Cancel Subscription, as described in Apple's guidance above. On Android, cancelling stops the next renewal; Pro stays active until the end of the period already paid for, then the app reverts to Free. iOS paid-through access and expiry handling still need real purchase lifecycle verification.

Statutory right to cancel (United Kingdom): a different thing entirely. Separately from stopping a renewal, UK consumers who buy at a distance have a 14-day right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. It does not depend on anything being wrong, and you do not have to give a reason. You may exercise it using the model cancellation form in Part B of Schedule 3 to those Regulations, which we reproduce on our Refunds and 14-day right to cancel page, or by any other clear statement setting out your decision to cancel; the form is not obligatory and an email is enough. Because Pro is digital content rather than a service, the proportionate charge that applies when a consumer cancels a part-performed service does not apply to it. Where regulation 37 of those Regulations applies and the required prior express consent, acknowledgement or durable confirmation was not obtained, the consumer bears no cost for the digital content supplied during the cancellation period. The Refunds page sets this out with the wording of the Regulations. This website is not the checkout and is not a durable medium, so nothing here obtains that consent or serves as that confirmation.

Signing out does not cancel billing. Signing out of Google, disconnecting or revoking YouTube access, changing a YouTube channel or Brand Account, clearing local app data, or uninstalling BenchStream does not cancel either store subscription. You must cancel through the originating store.

Refunds. Our full refund policy is set out on the Refunds and 14-day right to cancel page and forms part of these terms. Which route to use depends on what you are asking for. Where you are exercising a statutory right, including the 14-day right to cancel above or a claim that Pro was faulty or not as described, write to us at support@bench-stream.com. For Google Play statutory requests: You never have to approach the store first, and we will not redirect you there. Where you simply want a discretionary refund quickly, the store's own process is often the faster route: Google Play's refund flow or Apple's Report a Problem service. On Google Play we can also refund directly, whether because a refund is owed or as a goodwill gesture. For future Apple-billed purchases, Apple's refund guidance explains how to request a refund and obtain Apple's decision. You can also contact us about a fault or statutory claim without first using Apple's process. The Apple route does not limit statutory rights or decide which trader owes a legal remedy; that allocation remains under review before iOS sales. Please write from the email address of the store account you bought with, and include your order ID if you have it, so we can find the purchase and see that the request comes from the person who paid. A reason is welcome for a fault or a goodwill request and is never required for a statutory cancellation.

Neither our refund policy nor a store's process limits the statutory rights you have as a consumer, and those rights differ by country. The Refunds and 14-day right to cancel page sets out the position for the United Kingdom, the United States, Canada and Australia. We do not currently sell Pro in the European Economic Area, and we will set out EEA withdrawal and conformity rights on that page before we do.

If a payment fails. The originating store controls billing retries, grace periods, and account holds. On Google Play, Pro stays active during a grace period while Play retries payment. If Play later puts the subscription on account hold, Pro locks after BenchStream receives a definitive fresh store result. If payment is not resolved on Google Play, the Android subscription ends and the app reverts to Free. On Android, BenchStream does not end a stream already running because of a subscription-status change. iOS payment recovery, grace, expiry, and active-stream entitlement behavior still require real purchase lifecycle verification; draft implementation and local tests do not establish a shipping guarantee.

11. No warranty

To the maximum extent permitted by law, BenchStream is provided "as is" and "as available", without warranties of any kind, whether express or implied. This includes implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or that the service will be uninterrupted, secure, or error-free.

We do not guarantee that your stream will reach YouTube, that it will be of a particular quality, that any specific feature will be available, or that bugs will be fixed within any particular time.

Your statutory rights come first. This section applies only so far as the law allows. It does not exclude, restrict or modify any right or guarantee you have as a consumer that cannot be excluded, and nothing in it should be read as saying such rights do not apply to you.

Australia. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.

United Kingdom and European Economic Area. Your rights to have services carried out with reasonable care and skill, and to receive digital content and services that match how they were described to you and are of satisfactory quality, cannot be excluded. Those rights are unaffected by this section.

12. Limitation of liability

To the maximum extent permitted by law, we are not liable for: lost or interrupted streams, lost footage, lost viewership, lost revenue, lost data, business interruption, or any indirect, incidental, consequential, special, or punitive damages arising from your use of (or inability to use) BenchStream.

Where liability cannot be excluded by law, our total aggregate liability to you in connection with BenchStream is limited to the greater of (a) £50 or (b) the amount you paid for BenchStream Pro, whether paid to us directly or collected through an app store, in the twelve months before the event giving rise to the liability. This limit does not apply to any liability that cannot be limited by law, including under the consumer guarantees described in section 11.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under the law that applies to you. For consumers this includes, without limitation: your rights under the Consumer Rights Act 2015 in the United Kingdom; the consumer guarantees under the Australian Consumer Law in Australia; your rights under applicable federal and provincial consumer protection legislation in Canada; your rights under applicable federal and state consumer protection law in the United States; and your rights under applicable consumer law in the European Economic Area. Where any limit in this section conflicts with a right that cannot be excluded, that right prevails.

13. Indemnity

If you use BenchStream on behalf of an organisation, or if a third-party claim arises from your unlawful use of BenchStream, your breach of these terms, or your violation of someone else's rights, you agree to indemnify us against the resulting claims, damages, and reasonable legal costs. This clause does not limit any non-waivable rights you have as a consumer.

14. Termination

You can stop using BenchStream at any time by signing out, revoking its Google access, and uninstalling the app. Those actions end local app access or Google/YouTube authorization only; they do not cancel recurring store billing. Cancel Google Play Pro or App Store Pro separately through its originating store. We may stop distributing BenchStream, providing support, or operating an online feature we control if required by law or if the service is discontinued. On termination, the licence granted in section 7 ends. Section 7's ownership and use-restriction provisions, and sections 5, 6, 8, 9, 10, 11, 12, 13, 15, 16, 17 and 18, survive where relevant to past use and unresolved claims.

15. Changes

We may update these terms from time to time. If we make material changes, we will update the "Last updated" date. The Android app checks for legal updates when opened and can show a notice when that check succeeds, then requests agreement to a new consent version when it takes effect. The iOS legal-update notice and consent flow exists in draft source with local versioned receipts and cached documents; approved content and material-change behavior must be verified before release. Publishing this website alone does not deliver an iOS in-app notice. Where practical, we will give at least 30 days' notice before material changes take effect. Continuing to use BenchStream after the notice period means you accept the updated terms. If you do not agree, please stop using BenchStream.

16. Governing law and jurisdiction

These terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute, subject to your non-waivable rights as a consumer to bring proceedings in the courts of the country where you live.

17. General

If any part of these terms is found to be unenforceable, the rest of the terms will remain in effect. We are not responsible for failure or delay caused by events outside our reasonable control, including network outages, device failures, app store issues, YouTube or Google service problems, power failures, strikes, extreme weather, or changes in law. These terms, together with the Privacy Policy and any app-store terms that apply to your download, form the agreement between you and us for BenchStream.
